Terms of Service
These terms govern your use of the LongestRally platform and your participation in tournaments organized through it. By creating an account, you agree to these terms.
1. Scope
These Terms of Service apply to the use of the LongestRally website and all tournaments organized through it. The platform is operated by Nikita Pashkov, Oranienburger Str. 70, 10117 Berlin, Germany. By registering an account, you accept these terms in full.
2. Registration
You must provide accurate and complete information when creating your account. Each person may register only one account. Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your password.
3. Tournament Participation
By enrolling in a tournament, you commit to participate on the scheduled date and time. Participants must comply with the Tournament Rules and the rules of the venue where the tournament takes place.
By enrolling, you confirm that you are in good physical health and fit to participate in competitive tennis. If you have any medical conditions that could be affected by physical exercise, consult a physician before participating.
4. Physical Activity & Liability
Tennis involves inherent risks of physical injury including but not limited to muscle strains, sprains, falls, and impacts from balls or rackets. By enrolling in a tournament, you acknowledge and accept these risks.
To the extent permitted by German law (§ 276 BGB), the organizer's liability for damages arising from simple negligence is excluded, unless such damages involve injury to life, body, or health.
Important: Liability for gross negligence (grobe Fahrlässigkeit), intentional misconduct (Vorsatz), and injury to life, body, or health is not excluded and remains in full force under German law. This limitation cannot be waived.
Participants are strongly advised to have adequate personal accident insurance and third-party liability insurance (Haftpflichtversicherung).
5. Cancellation
You may cancel your enrollment at any time before the tournament date through the platform at no cost. Late cancellations or no-shows may affect your ability to enroll in future tournaments at the organizer's discretion.
Currently, tournament entry fees are not collected through the platform. Should paid entry fees be introduced in the future, a separate refund policy will be published, and the statutory 14-day right of withdrawal (Widerrufsrecht, §§ 355 ff. BGB) will apply to qualifying consumer transactions.
6. Public Display of Names
By accepting these terms, you consent to the following public display of your name:
- Your full name appears on tournament participant lists, visible to all website visitors.
- Your name appears on the public rankings page — abbreviated for logged-out visitors (e.g. "Nikita P.") and in full for logged-in users.
You may withdraw this consent at any time by deleting your account. Note that withdrawing consent does not affect the lawfulness of processing that occurred before the withdrawal.
7. Code of Conduct
All participants must adhere to the Tournament Rules, including the code of conduct section. Fair play and sportsmanship are expected at all times. The tournament organizer may disqualify participants who violate the code of conduct.
8. Photos & Media
If photos or videos are taken at tournaments in the future, we will collect separate, explicit consent before publishing any images that identify individual participants. General consent to these Terms of Service does not constitute consent to be photographed or filmed. No photos or videos will be published without your permission.
9. Changes to Terms
We reserve the right to modify these terms with reasonable advance notice. Material changes will be communicated via the email address associated with your account. Continued use of the platform after the notice period constitutes acceptance of the updated terms.
10. Governing Law & Jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Berlin, Germany, to the extent permitted by law.
11. Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
